ILLINOIS ENACTS HARSH NEW REQUIREMENTS
On May 25, 2012 the Illinois House and Senate passed major Medicaid legislation which dramatically alters the requirements for Illinois residents to receive Medicaid assistance both in the community and supportive living and skilled care facilities. While the ultimate impact of this harsh revision is not yet known, it will undoubtedly have an adverse impact on both Illinois' Elderly and Illinois' Supportive and Skilled Care Facilities. The Elder Law Attorneys associated with the Illinois Chapter of the National Academy of Elder Law Attorneys were able to get some of the initially proposed harsh provisions as to Community Spouses modified, many other harsh and punitive provisions remain. While the Elder Law community will seek to reduce the harsh and punitive results of these new laws through legislative, administrative and judicial efforts, until such efforts are successful each resident of the State of Illinois, whose parents, grandparents or they themselves are not of unlimited financial means, will have to have to face the realities of these new laws.
